    By accessing or using RiseLayer, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our platform.

    1. Service Description

    RiseLayer LLC provides a revenue calculator, revenue audit follow-up support, and communication automation / customer relationship management (CRM) software designed specifically for plumbing businesses. Our services include:

    • Revenue leak calculator and follow-up communication
    • AI-powered SMS and voice call automation
    • Appointment scheduling and reminders
    • Job tracking and technician management
    • Customer follow-up automation
    • Communication analytics and reporting

    1a. SMS Communication Terms

    By checking the SMS consent box on any RiseLayer form (including the Revenue Calculator at /revenue-calculator), you expressly consent to receive SMS messages from RiseLayer LLC regarding your revenue results, appointment reminders, and service updates.

    • Message frequency varies based on your account activity and the service context.
    • Message and data rates may apply from your wireless carrier.
    • Opt-out: You may opt out at any time by replying STOP to any SMS message. After opting out, we will send one confirmation message and no further messages will be sent unless you reply START to re-subscribe.
    • Help: Reply HELP to any SMS message to receive support information, or contact support@riselayer.app.
    • Consent to receive SMS messages is not a condition of any purchase.
    • You must be 18 years or older and the authorized user of the phone number you provide.

    Your mobile information (phone number, SMS opt-in status) is not sold and is not shared with third parties for marketing purposes. See our Privacy Policy for details.

    2. Your Responsibilities

    As a RiseLayer user, you agree to:

    • Provide accurate and current business information
    • Maintain the security of your account credentials
    • Comply with all applicable laws, including TCPA, CAN-SPAM, and telemarketing regulations
    • Obtain proper consent before sending SMS or making calls to customers
    • Not use RiseLayer for spam, harassment, or illegal activities
    • Not attempt to reverse engineer, hack, or disrupt our platform

    3. Communication Compliance

    You are responsible for compliance with communication laws.

    This includes:

    • Obtaining proper consent before sending SMS or making calls
    • Honoring opt-out requests (STOP messages)
    • Not calling numbers on the Do Not Call registry
    • Following TCPA regulations for automated calls and texts

    RiseLayer provides tools to help you comply, but ultimate responsibility rests with you.

    4. Payment and Billing

    RiseLayer charges subscription fees and usage-based fees for communication services.

    • Subscription fees are billed monthly or annually in advance
    • Usage fees (calls, SMS) are billed based on actual consumption
    • All fees are non-refundable except as required by law
    • We may change pricing with 30 days notice
    • Failure to pay may result in service suspension

    5. No Revenue Guarantees

    RiseLayer is a software tool. We do not guarantee any specific business outcomes, revenue increases, or results. Your success depends on many factors outside our control, including your business practices, market conditions, and how you use our platform.

    6. Limitation of Liability

    RiseLayer is provided "as is" without warranties of any kind.

    To the maximum extent permitted by law:

    • We are not liable for indirect, incidental, or consequential damages
    • Our total liability is limited to the amount you paid us in the last 12 months
    • We are not responsible for third-party service failures (Twilio, AI providers, etc.)
    • We do not guarantee 100% uptime or error-free service

    7. Termination Rights

    You can cancel your account at any time.

    We reserve the right to suspend or terminate your account if:

    • You violate these Terms of Service
    • You engage in fraudulent or illegal activity
    • You fail to pay fees
    • Your use harms our platform or other users

    Upon termination, you lose access to your account and data. We may retain data as required by law.

    8. Data and Privacy

    Your use of RiseLayer is also governed by our Privacy Policy. By using our platform, you consent to our data practices as described in the Privacy Policy.

    9. Changes to Terms

    We may update these Terms of Service from time to time. We will notify you of significant changes by email or through our platform. Continued use after changes constitutes acceptance of the updated terms.

    10. Governing Law

    These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
